TIME LIMITS

All Australian States and Territories require claims for compensation to be made within specified time periods.

These periods vary from State to State and Territory, depending on the type of claim.

In most States the time limitation period for commencing Court proceedings in motor vehicle, medical negligence and public liability claims is three years.

In most motor vehicle cases formal notice of the claim must be given to the relevant insurer within six months of the date of the accident.

These time limits can be extended in certain circumstances. It is thus critical that claims be commenced expeditiously.
